Hummel Exchange Terms of Sales and Service

1. All products owned by and sold by Hummel Exchange as the sole property of Hummel Exchange are sold "As Is" without any warranty. Due to the nature of antiquity, no refunds or exchanges will be allowed or honored. It is the sole responsibility of the purchaser to maintain and take good care of the item(s) purchased. Any and all Sales Are Final.

2. Hummel Exchange does guarantee the quality and authenticity of the items that are the sole property of Hummel Exchange prior to shipment. Hummel Exchange does not guarantee against damage or loss during shipment. The appropriate insurance is required and will be purchased by the customer(s)/purchaser(s) at the customer(s)/purchaser(s) expense.

3. All items that are the sole property of Hummel Exchange will be shipped insured at the customer/ purchaser(s) expense. Once an item has been shipped and a tracking number or conformation number has been issued, Hummel Exchange or any of its staff is no longer responsible for the care of the item(s) shipped. If the item is damaged during shipment, it is the sole responsibility of the customer/purchaser(s) to file a claim with the appropriate shipping agency that the item(s) were shipped and insured through. All items will be photographed and cataloged prior to shipment as proof of condition when packed. Once an Item has left the possession of the Hummel Exchange, it is no longer the responsibility of the Hummel Exchange and will be treated as such.

4. All item(s) purchased will be shipped within 3 (three) business days. Hummel Exchange will honor the cancellation of any order that is deemed as the sole property of the Hummel Exchange prior to the shipment of the order. Once an order has been shipped, Hummel Exchange will not accept the cancellation of the order, and the customer(s)/purchaser(s) agree to, and acknowledge these terms. In the event of dispute of charges, the customer(s)/purchaser(s) agrees to pay any additional legal fees necessary or accrued to settle the debt.

5. Any item(s) listed that are not the sole property of Hummel Exchange will be clearly marked as "Not the Property of Hummel Exchange". This is done to clarify what is the sole property of the Hummel Exchange and what is not.

6. Hummel Exchange is not responsible and will not be held liable for any and all consignment sales/arrangements or any other advertising arrangements. Hummel Exchange is not the owner of, and retains no rights to any of the consignment listings or any other advertising listings found within the Hummel Exchange Web Site that are not the sole properties of Hummel Exchange. In the event of sales or dispute of sales, Hummel Exchange will not be involved in any legal, criminal, collections, sales or any other agreements or negotiations between any parties involved in the purchasing of consignment goods or any other advertised goods that are not the sole property of the Hummel Exchange and will not be held liable by any parties under any circumstances.

7. Any and all products marked as damaged and sold as damaged, is sold as is, without warrantee. To avoid shipping fraud, any packages/item(s) shipped that are explicitly marked as damaged, will be disclosed to the shipping agency as damaged goods. No refunds or returns will be authorized or permitted/honored in the event that any marked damaged goods purchased by the customer/purchaser(s). Details and extent of damage will be provided prior to any final purchase.

8. Any damaged goods are open for offers. Hummel Exchange reserves the right to refuse any offers that is not deemed agreeable by the Hummel Exchange and its staff. Upon request additional detailed information will be provided to the customer/purchaser(s) regarding the condition of any products.

9. Hummel Exchange reserves the rights to refuse services on any and all transactions as it sees fit. Due to inventory issues, some items that are purchased may not be restocked. In this event, any transactions related to out of stock item(s) will be returned and your credit card will be either credited or not charged.

10. Hummel Exchange understands and respects the privacy of its customer(s) and will not be retained, resold, or share any information provided by the customer(s)/purchaser(s) without the expressed written or opt-in permissions of the customer(s)/purchaser(s). Hummel Exchange shopping cart can retain customer information at the customer(s)/purchaser(s) discretions. If the customer(s)/purchaser(s) does not wish to set up an account, the customer(s)/purchaser(s) has the option to manually enter in their information each transaction.

11. Hummel Exchange accepts Visa, MasterCard, Discover, and American Express as terms of payment. Additional terms can be negotiated. A $15.00 C.O.D. charged will be assessed to any and all C.O.D. negotiated transactions. Hummel Exchange will accept certified checks or money orders as terms of payment as well, however, arrangements will have to be made for such transactions.

12. By confirming any and all transactions on the Hummel Exchange, you agree and authorize your credit card to be charged the amount settled, negotiated, or set upon or fixed upon sale price. In the event of any incorrect information, shipping or otherwise, Hummel Exchange reserves the right to correct any and all transaction or refuse the finalization of sale. In the event of incorrect purchase information, Hummel Exchange will notify you as to the problem and offer you the opportunity to accept the new charges or decline the charges. In the event that the charges are declined, any and all transactions pertaining to the new charges will be null and void.

13. Hummel Exchange reserves the right to change any and all terms as it sees fit without any further notice.

14. Hummel Exchange retains the right to add or change any and all fees or advertising rates within the consignment and/or any advertising section of this web site. Hummel Exchange will provide a 10 (ten) day notice prior to any changes made in fees or advertising rates to allow you the opportunity to accept or decline the new fees or rates. In the event that the new fees or rates are declined, any and all listings or posts will be removed immediately without any further notice.

15. Hummel Exchange reserves the right to refuse services. If any content provided is abused or is deemed as inappropriate by any of the Hummel Exchange staff, any and/or all items, posts or listings will be removed from the Hummel Exchange web site. Hummel Exchange also reserves the right to remove any and/or all listings within the Hummel Exchange web site at any time with out any explanation as to the nature or course of it's actions.

16. Hummel Exchange is not liable for the sales or lack of sales of the items posted within the consignment and/or any advertisings, and will not guarantee the authenticity or quality of the items posted and will not be held liable for any information (correct or incorrect) provided. Hummel Exchange also will not guarantee you a listing or post.

17. Hummel Exchange offers no guarantee, warranties, or returns of items posted within the consignment and/or any advertisings. The guarantee, warranties, and returns of any and all items or properties posted within the consignment and/or any advertising, remain the sole responsibility of the individual(s) or company(s) who have posted them.

18. Hummel Exchange is not liable for any damages to any of the items or properties posted within the consignment and/or any advertisings in any way, shape, or form.

19. Hummel Exchange is not liable or responsible for collection of any moneys, transactions, or the sale(s) of the items or properties posted within the consignment and/or any advertisings.

20. Hummel Exchange does not claim rights to, or ownership of the items and properties posted within the consignment and/or any advertising sections of this web site. All items posted within the consignment and/or any advertisements other than the properties of Hummel Exchange remain the sole property of the individual(s) or company(s) who have posted them. Hummel Exchange will not be liable for transfer of ownership of the items or properties in any way other than the sole item properties of Hummel Exchange.

21. Hummel Exchange will not be apart of any legal disputes, or is not liable for any damages, legal or otherwise.

22. Hummel Exchange is not and will not be held accountable for; liable for; or responsible for any lawsuits, collections, legal fees or counsel, disputes, acts of god or nature, shipping, storage, quality and/or authenticity, returns and warranties, nor sales of any items posted within this site in any way. Hummel Exchange retains no ownership or responsibility of any items posted within the consignment and/or any advertising sections of this web site, and is not partnered with or in agreement with either or any parties listed, advertised, or posted within the consignment and/or advertising sections and/or wanted section of this site and will not offer any services, support or any council otherwise.

24. By confirming your order you agree to all of these terms and conditions and you validate and authorize the charge of your credit card and agree not to dispute any charges after your order has been shipped. If you wish to cancel your order prior to shipment, please contact the sales department of Hummel Exchange. If you fail to notify Hummel Exchange of any cancellations prior to shipment, then you agree to take full responsibility and pay all and any charges related to your order.

25. All material(s) (text, photos, graphics, etc.) published within the Hummel Exchange web site is by copyright and protected by law and can not be reproduced without prior written authorization by the Hummel Exchange.
